In 2002 and 2003, the Land Registry introduced new rules. According to the 2003 Rules, any new lease lasting seven years or more must be registered with the Registry and include a compliant lease plan. As part of the lease application, you must produce and submit this compliant lease plan.
What is a Lease Plan?
A lease plan is a detailed drawing or diagram that shows which parts of a property are included in a lease. It is drawn to scale and outlines in red the areas covered by the lease. This includes any land, outbuildings, and garden areas associated with the property.
Do You Already Have a Lease Plan? Can You Use It?
If your property was registered before 2002, your existing plan likely does not meet the current Land Registry guidelines.
Guidelines for Creating a Lease Plan
When preparing a property plan for a lease, adhere to these guidelines:
- Draw to Scale: Use a specific scale, typically 1:1250 to 1:500 for urban properties and 1:2500 for rural properties.
- Include Sufficient Detail: Ensure the plan shows enough detail for the property to be easily located on an Ordnance Survey map. Include nearby roads, junctions, and landmarks.
- Use a Bar Scale: Include a bar scale in metric measurements to indicate the scale of the drawing.
- Show Flats and Maisonettes: If the property is a flat or maisonette, the plan must indicate its position within the building’s outer footprint.
- Include Multiple Floors: For properties spanning multiple floors, show each floor’s layout. Separate plans may be necessary for each floor.
- Detail Intricate Boundaries: Use a larger scale for complex boundaries, such as internal divisions within a building.
- Match the Description: Ensure the plan corresponds with the verbal description in the deed.
Plans may be rejected if they are unclear, not to scale, or do not match the verbal description. Additionally, if the location and alignment cannot be accurately placed on an Ordnance Survey map, the plan will not be accepted.
